These Terms and Conditions ("Terms") govern your use of the PostOwl website postowl.io (the "Site") and our services (the "Services") provided by Andify OÜ ("PostOwl," "we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Services.

Account Registration

  • You must be at least 13 years old to register for an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You agree to provide accurate and complete information when registering for an account.

Use of Services

  • You agree to use our Services only for lawful purposes and in accordance with these Terms.
  • You agree not to:
    • Violate any applicable laws or regulations.
    • Infringe the rights of others.
    • Transmit any harmful or malicious code.
    • Interfere with the operation of our Services.
    • Attempt to gain unauthorized access to our systems or data.
    • Scrape or collect data from our Services without our permission.

Content Ownership and Responsibility

  • You retain ownership of the content you create using our Services.
  • You are solely responsible for the content you create, including its accuracy, legality, and appropriateness.
  • You grant PostOwl a non-exclusive license to use, reproduce, and display your content in connection with providing our Services.

AI Model Usage

  • PostOwl utilizes AI models to generate content, such as post and reply suggestions.
  • While we strive for accuracy and relevance, AI-generated content may not always be perfect and might contain errors or unintended biases.
  • You are solely responsible for reviewing and editing any AI-generated content before publishing or sharing it.
  • You may not use our AI generated content for illegal purposes.

Third-Party Service Limitations

  • Our Services rely on integration with third-party platforms, including X/Twitter, LinkedIn, Meta (Facebook and Instagram), and TikTok.
  • You acknowledge that your use of these platforms is subject to their respective terms of service and policies.
  • We are not responsible for any disruptions, limitations, or modifications imposed by these third-party platforms, including but not limited to API changes, account restrictions, throttling, or suspension of service.

Social Platform Compliance

When you connect and publish to a third-party social platform through our Services, you agree that:

  • You will comply with the terms, policies, and community guidelines of each connected platform, including the Meta Platform Terms and Community Standards, the Instagram Community Guidelines, and the TikTok Terms of Service and Community Guidelines.
  • You have all necessary rights to the content you publish and the authority to post to the connected accounts and Pages.
  • You authorize PostOwl to access the connected platform and publish content only at your direction; we act on your behalf and do not post without your action.
  • You are responsible for setting any platform-required disclosures — for example, TikTok branded-content/commercial-content settings and the privacy level of each post, which you must select yourself.
  • You acknowledge platform-specific limitations: Facebook supports publishing to Pages you administer only (not personal profiles); Instagram publishing requires a Business or Creator account linked to a Facebook Page; and TikTok posts may be restricted (for example to private visibility) until and unless the required platform approvals are in place.
  • PostOwl's collection, use, and transfer of any information received through these platforms' APIs adheres to each platform's developer policies, including the Meta Platform Terms and Developer Policies and the TikTok Developer Terms of Service.

Fees and Payments

  • Some of our Services may require payment of fees.
  • You agree to pay all fees associated with your use of our paid Services.
  • We may change our fees from time to time. We will provide you with notice of any fee changes.
  • All fees are non-refundable, except as required by law.

Termination

  • We may terminate your access to our Services at any time for any reason, including violation of these Terms.
  • You may terminate your account at any time by contacting us.
  • Upon termination, your right to use our Services will immediately cease.

Disclaimer of Warranties

  • Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied.
  • We do not warrant that our Services will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of Liability

  • In no event shall PostOwl be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our Services.
  • Our total liability to you for any claim arising out of or relating to these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Estonia.

Changes to These Terms

We may update these Terms from time to time. We will post any changes on our Site and update the "Last Updated" date above.
